Timothy Wayne Indicted On Kiddy Porn Charges

Pleads Not Guilty, Seeks Plea Deal

Rockaway resident Timothy Wayne, better known to the community as “Tim the Viking,” was indicted in the Eastern District Federal Court on July 17, charged with four counts of receipt of child pornography and possession of child pornography.

Federal sources told The Wave this week that Wayne pled not guilty to the charges, but is involved in “extensive plea negotiations and undergoing a mental health evaluation.”

Because of that, Wayne’s next court date has been deferred to October 16 in order for the negotiations and the evaluation to be completed.

Wayne, a city Fire Department EMT is back to work, but has been placed on administrative duty, according to an FDNY spokesperson.

“He is restricted from patient interaction and care and restricted from driving any FDNY vehicle,” spokesperson Frank Dwyer said this week.

He also remains in his apartment at 164 Beach 122 Street in Rockaway Park.

And, that troubles some of the other residents of the six-unit house.

“My children play on the porch and he goes in and out,” said one resident who asked not to be identified.

“I’m afraid to allow my kids to play outside when he is around,” the resident said.

Wayne was released on $200,000 bond, secured by his parent’s Breezy Point home.

According to Wayne’s release papers, he can only leave his Beach 122 Street home for work, court appearances, medical appointments or attorney visits.

He must wear a monitoring leg bracelet at all times.

In addition, he cannot “have any contact or association with any individual under the age of 18, except when the minor is in the presence of another adult who is the parent or guardian of the minor.”

Residents tell The Wave that Wayne is regularly visited by his girlfriend and her toddler daughter, which officials say might be a violation of his release.

Court officials say that there is no indication on the record that a young girl is a regular visitor to Wayne’s apartment, but if it is true, then it would be grounds for revocation of his bond.

As ordered by the court, all the computers were removed from Wayne’s Rockaway apartment and he is restricted from using a computer or accessing the Internet except for duties associated with his job.

Wayne was arrested at his Rockaway Park home on March 29 by federal officials who found such videos as “Toddler Girl: Stop, Don’t Stop,” “Studio 10YO,” and “Yo Girl, Pedoland.”

Federal investigator Robert Mancene, an agent with Homeland Security Investigations, said that in October of last year he was investigating computers with New York IP addresses that were sharing child pornography files in the Internet.

Wayne’s Internet address was one of those under investigation, court records show.

Based on the Internet findings, a number of agents executed a warrant at Wayne’s Rockaway address on March 29.

Wayne was home at the time and told the investigators that he had lived at that address for about a year.

Among the computers in the apartment, Mancene found an external hard drive sitting on top of a desktop computer tower.

A check of the external hard drive revealed videos and images depicting child pornography. The contents of the videos were described in detail in the criminal complaint against Wayne. Some of them depicted pre-teen girls having sex with men and each other. Others were scenes of pre-teen girls undressing and caressing themselves for the camera.

In at least one of the videos, officials say, the child in the video was identified by the National Center for Missing and Exploited Children as a missing person.

On March 29, federal officials say,

Wayne admitted that he had searched and downloaded child pornography.

Federal officials say that they are checking the allegation that Wayne has regular contact with a female toddler.
