Gutless State Legislators

Dear Editor,

I received a press release from Assemblywoman Audrey Pheffer, railing against the discount on the Cross Bay Bridge for local residents being taken away. At least she is trying to do something, and that is more than I can say about many of our local politicians. I believe that all tolls collected in the state of New York are ILLEGAL and are in violation of Federal Law.

The Cross Bay Bridge along with Marine Park Bridge in 1934 was built under the Bridge Act of 1906, and that means that when ALL expenses are paid, tolls can only be collected periodically for repairs. For example, in 1980 the Verrazano Bridge collected 156 million dollars. 30 million was used for repairs and upkeep.

The remainder went ILLEGALLY to the MTA. However the Highway Act of 1987 made everything nice and legal and no money had to be paid back. Here is something to think about. Before the Highway Act of 1987 went into effect there are court cases where the tolls were challenged, and in every case the tolls had to be removed and could only be put back to collect the money for upkeep. In one town in Ohio I believe, the town showed that it was paying their Police Department with the money collected from the tolls, and therefore the town had no other choice but to collect tolls. The judge ruled that the town must find another way to pay the Police Officers, because the tolls must be removed. Since the Highway Act of 1987 a challenge to the tolls boils down to TWO things JUST and REASONABLE. Do you think it is just and reasonable to collect 156 million dollars annually when it only costs 30 million dollars annually for repairs on the Verrazano Bridge. But have no fear you are stuck with tolls because there isn’t a politician in the state of New York that has the guts to bring this matter to court.

Can any of our politicians show us one state that tolerates this unjust and ILLEGAL collection of tolls?

Take a drive across beautiful America in your spare time. I can assure you, you won’t be going through too many tolls and you will see the beauty of our land right before your eyes. Don’t spend all your money because you will need a few Quid to go through the tollbooths that bombard New York to get back to your dwelling.
