for larger version       Drug Bust Puts Bayswater Resident Behind Bars A Bayswater resident was arrested last month and charged with possession and intent to sell marijuana and possession of several deadly weapons after they were found in his Dix Avenue apartment. As a result of what may have been a misunderstanding with the Queens District Attorney's office last week, The Wave reported that charges against Michael J. Disbato, 20, who was arrested for possession and sale of marijuana and the possession of a 12- gauge shotgun, were dropped and the case sealed. According to a spokesman for Queens District Attorney Richard Brown, however, the information provided to this newspaper was in error. "Initially there were two complaint numbers on file for Mr. Disbato. [One was] discarded and not accepted for prosecution," said Assistant District Attorney Kevin Ryan, in an e-mail to The Wave this week. "However under another complaint, Mr. Disbato has been charged with numerous crimes, including felony criminal possession of marijuana, a class E felony punishable by up to four years in prison." Disbato was arraigned on March 16 after, according to police records he was arrested the previous day by the 101 Precinct's Anti-Crime Team after they observed him and another man, Dori Kuritzky, 24, of Cedarhurst, in the process of a marijuana sale in front of 21-07 Dix Avenue. As reported last week, officers followed Disbato into his first floor residence in the Dix Avenue apartment building. Upon entering the suspect's home, officers immediately noticed large a large quantity of marijuana and a firearm out in plain view in the living room. After obtaining a search warrant, police found additional bags of marijuana and an unloaded shotgun, United States currency in several different denominations, various drug paraphernalia, and growing apparatus/ heat lamps were also found in the apartment. According to the arresting officer, Donnell Myers of the 101 Precinct, more than eight ounces of marijuana were taken from the apartment, which included 15 large bags of marijuana, as well as six marijuana plants. Court records show that "a dagger, dangerous knife, dirk, razor, stiletto, imitation pistol, shirken of Kung Fu Star or another dangerous or deadly instrument" were found in the apartment. Disbato was charged with criminal possession of marijuana in the third degree, criminal possession of a controlled substance in the seventh degree, criminal possession of a weapon in the fourth degree and criminal sale of marijuana in the fifth degree. Disbato remains in jail in lieu of $5,000 bail. His next court date is May 7.
Kuritzky, who was charged with criminal possession of marijuana in the fifth degree - a class B misdemeanor - was also arraigned on March 16. He was released and the case will be dropped if he stays out of trouble for the next six months.
