Assembly Passes Medical Confidentiality Bill

The State Assembly recently passed legislation, sponsored by Assemblywoman Audrey I. Pheffer, to establish a task force on medical record confidentiality relating to the disposition or transference of medical records.

The legislation would require the Commissioner of Health to establish a Task Force on Medical Record Confidentiality, to review issues concerning the transference of medical records if a medical office closes or if the doctor dies or abandons his or her practice.

Pheffer said that the task force would deal with the issues faced by the patients of the Select Dental Office on Cross Bay Boulevard, which closed abruptly this past November.

There is currently no statutory or regulatory practice for ensuring the confidentiality of patient records in the event of a medical office closing.

The bill has not been introduced in the State Senate yet.
