Girvan, who worked as a baggage handler at John F. Kennedy Airport, was declared dead at the scene. The two passengers in the car, identified by court records as Arnold MacCray, 19, and Angie Felix, 26, were taken to Jamaica Hospital and are reportedly in stable condition at press time.
Creary was charged by police with driving while under the influence. While officials would not release the results of the Breathalyzer test given to Creary, Police Officer David Burgos of the 100 Precinct, who responded to the accident, said that Creary had "a strong odor of alcohol on his breath, slurred speech and that he was unsteady on his feet." Creary was taken to Jamaica Hospital, where he was arrested and placed under police guard. He remains in stable condition at the hospital. Published reports say that Creary has a history of drug arrests, including an arrest in October of 2005 for selling drugs to an undercover police officer and a misdemeanor marijuana charge in 2006. A spokesperson for Queens District Attorney Richard Brown said that Creary was arraigned on August 11 on charges of vehicular assault, vehicular manslaughter, criminally negligent homicide and operating a motor vehicle while under the influence of alcohol or drugs.
