for larger version       'Justice' Done In Spurgeon Slay Arrest
Favor, a suspected member of the gang GIB (Get It in Bricks), was arraigned on a 14-count indictment charging him with two counts of second degree murder, seven counts of second-degree attempted murder, one count of second-degree criminal possession of a weapon, one count of fourth-degree criminal possession of a weapon and three counts of endangering the welfare of a child. "The defendant is accused of acting with wolf pack mentality as he and three accomplices shot and then ran over their victim with their car," Brown said in announcing the indictment. "The defendant's alleged actions are another unfortunate example of the lethal consequences of senseless gun violence that all too often takes innocent lives and recklessly endangers public safety." Brown said that, according to the indictment, Favor is one of four individuals - including Andrew Smalls, Basil Davis and Supreme Favor - responsible for the death of Laton Spurgeon, 26, who was shot and then struck by a car after leaving his brother's home in Far Rockaway on the morning of December 19, 2006. Spurgeon, who was shot in the leg and back, was transported to a local Queens hospital where he was pronounced dead. In addition, the indictment alleges that the four men sprayed the neighborhood with bullets before leaving the murder scene, endangering the lives of at least seven people, including one child. Police officials told The Wave in January that GIB and the Bloods have been in a war to gain supremacy in the drug trade in several of Rockaway's public housing complexes. Several other members of both the Favor and Smalls families have been involved in the spate of shootings that struck Rockaway at the end of 2006. The Spurgeon shooting was one of the battles in that war, police say. Favor was arrested on June 29, at his St. Albans residence. At the time of his arrest, court records show, Favor was found to be in illegal possession of a loaded shotgun containing four live shells, as well as additional live shells and a quantity of heroin. Andrew Smalls, 20, of 76-00 Shore Front Parkway, and Basil Davis, 17, of 84-14 Rockaway Beach Boulevard, were arraigned on the indictment in March 2007 and are scheduled to appear in court on July 31. Supreme Favor, Justice's brother, is still being sought in connection with the Spurgeon murder. Andrew Smalls, one of the codefendants, is the brother of Cedric Smalls, who was shot and killed last December 15. Spurgeon was one of the suspects in that murder, police officials say. Supreme Favor was one of two men who were shot and wounded outside of a Hammel Houses building in June of 2003.
Justice Favor, who faces up to 25 years to life in prison if convicted, was ordered held without bail and to return to court on September 12, 2007.
