for larger version       DEC Orders Building On Beach 26 St. Dismantled
The New York State Department of Environmental Conservation has ordered that the front of a 15-story apartment building being constructed by American Dream Production Corporation, at 120 Beach 26 Street, be dismantled and set back 100 feet from the boardwalk and out of the DEC's coastal erosion hazard zone jurisdiction. "A consent order is out there…requiring them to move outside the coastal zone erosion area overseen by the DEC," said Udo Drescher of the DEC. According to Thomas Panzone, of the DEC, the dismantling of the building from the coastal erosion hazard zone will be done in three phases. American Dream Production Corporation must have the brick and steel structure being built in the coastal erosion hazard area removed by May 31. The concrete slab, footing and foundation must be removed by August 31, and piles and drywells by November 30. Clean sand must be placed in excavation areas created as a result of the removal procedures.
"Upon completion of construction activities, everything left in the coastal erosion zone area must be removed by February 2008," Panzone said in an email. American Dream Production Corporation did not return the newspaper's call for comment by press time. The Coastal Zone Management Act of 1972 works to protect coastal areas and its natural resources from development and pollution for ecological, cultural, historic and aesthetic purposes.
