Rockaway Park Curb Cut Is Completely Legal

Dear Editor,

I am writing in regard to the letter published in your column dated July 27, 2007 entitled, "A Parking Ticket For What?" We are the owners whose home address was so boldly printed in your publication.

First, let me state that the slanderous and defaming letter written by Mr. Michael Soto regarding our home is totally erroneous. Perhaps if Mr. Soto were more diligent before writing his letter to The Wave, he would have spent time investigating his accusation regarding the legality of the curb cut. This is a legal driveway approved by the Department of Buildings on March 2, 2001. Although we can empathize with the parking situation in our neighborhood, there must also be an understanding of the inconvenience of having our vehicle trapped on your property by people that allow their frustrations to disregard the property rights of homeowners.

Please be advised, Mr. Soto, you simply cannot call the Precinct and have a car ticketed if your curb cut is illegal. You have to provide proof if requested, which we have done on numerous occasions.

Most importantly, I'd like to address the Editor of the Wave. It is beyond our comprehension how you chose to publish this letter without being prudent. Is it not the function of an editor to thoroughly investigate any accusation before publishing it? Had prudence been practiced, neither The Wave nor our home would have been placed in the position of defending/ retracting false claims.

Since you did not find the time to investigate the validity of his statement, we are enclosing a copy of the permit that clearly states that the curb cut was approved.

Furthermore, we request that this letter be printed in its entirety in your next weekly publication. We also expect a retraction and public apology be made in the same fashion, as you allowed our integrity to be questioned.

As for Mr. Michael Soto, if he wishes to send a written apology, he certainly knows the address, as well as everyone who has read this article.
