Pheffer: Ephedrine Still Banned In NYS

Assemblywoman Audrey I. Pheffer wants to reassure New Yorkers that the recent Utah ruling striking down the FDA ban on ephedrine does not reverse the statute banning its sale in New York.

In 2003, the NYS Legislature enacted legislation that bans the sale of ephedrine within the state. The ruling in Utah last week only removed the FDA's ban on low dose, 10 milligrams or less, ephedrine supplements, keeping the ban in effect for those at higher levels. This ruling will have little effect in states such as New York, California, and Illinois, who have passed state statutes banning the sale of the supplement. "I want New Yorkers to recognize that this ruling in no way diminishes the important work we have done to ban the sale of ephedrine products in our state. I am hopeful that other states will follow New York's lead and ban this dangerous supplement," said Assemblywoman Audrey I. Pheffer, Chair of the Assembly Consumer Affairs and Protection Committee.

Many New Yorkers have also been confused with the wave of junk emails that many are receiving stating that the product is back and available for sale. "I myself have received emails stating that ephedrine is again available for sale, without any mention of its continued ban in New York. I have forwarded these messages to the Attorney General's office for their review, and possible criminal action. I also encourage others to do forward their ephedrine emails to the Attorney General.
