Man Sentenced Eight Years For Rape
A Far Rockaway man was sentenced to eight years in prison Monday for raping a 12-year-old girl who he met after she accidentally dialed his cell phone, Queens District Attorney Richard A. Brown announced.
Bernard Luster, 40, of 67-03 Beach Channel Drive pled guilty to rape in the first degree before Queens Supreme Court Justice Ronald D. Hollie who imposed a determinate sentence of eight years in prison. Luster had faced up to 75 years in prison.
Brown said that Luster admitted that on three occasions – July 16, 18 and July 23, 2003 – he drove to the victim’s home, picked her up and drove to a nearby location where he engaged in sexual intercourse with her. Their first conversation took place on July 15 when the girl misdialed her father’s cell phone number and reached Luster instead.
Luster at first claimed at that he and the girl did not have sex but simultaneously pleasured themselves in his car, according to a Daily News story published last month.
The victim’s mother learned of the destructive relationship between her daughter and the defendant and notified police prompting an investigation that led to Luster’s arrest, Brown said.
The girl’s name was not released due to her age and the nature of the crime.
